The new "Solid Waste Law" will be officially implemented on September 1, 2020, and environmental acceptance will be carried out independently
On April 29, 2020, the 17th session of the Standing Committee of the 13th National People's Congress deliberated and adopted the revised Law on the Prevention and Control of Environmental Pollution by solid waste, which will come into effect on September 1, 2020。
On the basis of comprehensively summarizing practical experience, the new "Solid Waste Law" highlights the problem orientation, implements the new development concept, responds to the expectations and practical needs of the people, improves the long-term mechanism for the prevention and control of environmental pollution by solid waste, and provides a solid legal guarantee for the fight against pollution prevention and control。The new Solid Waste Law has made positive progress in the following aspects:
(1) Make it clear that the prevention and control of environmental pollution by solid waste adhere to the principles of reduction, resource utilization and harmfulness, strengthen the supervision and management responsibilities of the government and its relevant departments, stipulate the target responsibility system, credit records, joint prevention and control, whole-process monitoring and information-based traceability systems, and require that zero imports of solid waste be gradually realized。
(2) Improve the system for preventing and controlling environmental pollution by industrial solid waste, strengthen the responsibility of producers, and increase the systems for discharge permits, management ledgers, and evaluation of comprehensive utilization of resources。
(3) Improve the domestic waste pollution prevention and control system, clarify the state to implement the domestic waste classification system, coordinate urban and rural areas, and strengthen the rural domestic waste pollution prevention and control of the environment。Local authorities may formulate specific measures for the management of domestic waste in light of actual conditions。
4. Improving the system for preventing and controlling environmental pollution from construction waste and agricultural solid waste，Establish a classification and whole process management system for construction waste，We will improve the system for preventing and controlling environmental pollution caused by agricultural solid waste such as straw, waste agricultural film, and livestock and poultry manure，The extended producer responsibility system will be extended to products such as lead batteries and automotive power batteries，We will intensify efforts to control excessive packaging and plastic pollution，Clarify the basic requirements of sludge treatment and laboratory solid waste management。
(5) Improve the prevention and control system of hazardous waste pollution, and stipulate the classification and management of hazardous waste, the information supervision system, and the construction of regional centralized disposal facilities。Strengthen the management of trans-provincial transfer of hazardous waste, and manage and share transfer data and information through information means。
(6) Effectively strengthen the management of medical waste, especially in response to major infectious disease outbreaks, further clarify the regulatory responsibilities of health, ecological environment and other departments, highlight the main responsibilities of medical and health institutions, medical waste centralized disposal units, and improve the emergency guarantee mechanism。
7. Improve the guarantee mechanism。A chapter on safeguard measures has been added to guarantee the prevention and control of environmental pollution by solid waste from the aspects of land use, construction of facilities and sites, economic and technological policies and measures, industrial specialization and large-scale development, technological progress in pollution prevention and control, government funding arrangements, environmental pollution liability insurance, and tax incentives。
(8) Strict legal responsibility, the implementation of "severe punishment and heavy punishment" for illegal acts, increase the amount of fines, increase the types of penalties, strengthen the punishment to the person, and supplement the legal responsibility for some illegal acts。
