Measures of Shenzhen Municipality for the Administration of Carbon Emission Trading

  The Administrative Measures for Carbon Emission Trading of Shenzhen Municipality, which were deliberated and adopted at the 42nd Executive Meeting of the 7th Shenzhen Municipal People's Government on May 19, 2022, are hereby promulgated and shall come into force as of July 1, 2022。

Chapter I General rules

  Article 1 For the purpose of controlling greenhouse gas emissions, realizing the vision of peaking urban carbon emissions and achieving carbon neutrality, and establishing a sound carbon emission rights trading market, these Measures are formulated in accordance with the Regulations of Shenzhen Special Economic Zone on Ecological Environmental Protection and other provisions。

  第二条 本办法适用于本市行政区域内碳排放权交易及其监督管理。

  纳入全国碳排放权交易管理的排放单位,按国家有关规定执行。

  第三条 碳排放权交易坚持公开、公平、公正和诚信原则,坚持碳排放控制与经济发展阶段相适应。

  第四条 市人民政府统一领导碳排放权交易工作,组织建设碳排放权交易市场。

  市人民政府应当建立稳定的碳排放权交易的财政资金投入机制,将碳排放权交易管理相关经费纳入财政预算。

  第五条  市生态环境主管部门对碳排放权交易实施统一监督管理。

  市生态环境主管部门的派出机构负责辖区内碳排放权交易的监督管理工作。

  第六条 市发展改革部门配合市生态环境主管部门拟定碳排放权交易的碳排放控制目标和年度配额总量。

  市统计部门负责制定重点排放单位生产活动产出数据核算规则并采取有效的统计监督措施。

  Municipal departments of industry and information technology, finance, housing construction, transportation, supervision and administration of state-owned assets, and local financial supervision shall exercise supervision and administration of carbon emission trading according to the division of responsibilities。

  供电、供气、供油等单位应当按照规定提供相关用能数据,用于碳排放权交易的管理工作。

  第七条  市生态环境主管部门负责建立健全碳排放权注册登记、温室气体排放信息报送等碳排放权交易管理系统。

  Shenzhen Carbon Emission Trading Institutions (hereinafter referred to as trading institutions) are responsible for organizing the unified trading of carbon emission rights, providing trading venues, system facilities and services, and ensuring the safe, stable and reliable operation of the trading system。

  Article 8 Encourage financial institutions to carry out financial innovation aimed at enhancing the emission reduction capacity of key emission units and the function of carbon emission rights trading market, develop carbon finance services such as carbon funds, carbon bonds, carbon emission rights pledge financing, structured deposits, and encourage exploration of innovative businesses such as carbon credit and carbon insurance。

  第九条 探索与国内其他省市和国际碳排放权交易体系建立碳排放权交易合作。

Chapter II Distribution and registration

  第十条  符合下列条件之一的单位,应当根据管理实际列入重点排放单位名单,参加本市碳排放权交易:

  (一)基准碳排放筛查年份期间内任一年度碳排放量达到三千吨二氧化碳当量以上的碳排放单位;

  (二)市生态环境主管部门确定的其他碳排放单位。

  纳入全国温室气体重点排放单位名录的单位,不再列入本市重点排放单位名单,按照规定参加全国碳排放权交易。

  Article 11 The municipal ecological environment department regularly organizes the screening of carbon emission units, determines the list of key emission units, implements dynamic management of the list, and announces it to the society。

  Article 12 Key emission units shall establish and improve the carbon emission management system, staff with carbon emission management personnel, take measures to reduce carbon emissions, report annual carbon emission data and output data of production activities, complete the implementation of carbon emission quotas, and disclose relevant information about carbon emissions in accordance with regulations。

  第十三条 碳排放权交易实施碳排放配额固定总量控制。The municipal ecological environment department shall, in conjunction with the municipal development and reform department, formulate the carbon emission control objectives and the total annual quota for carbon emission trading in accordance with such factors as climate change objectives, industrial development policies, industrial emission reduction potential, historical emission situation and market supply and demand。

  年度配额总量由重点排放单位配额和政府储备配额构成,政府储备配额包括新建项目储备配额和价格平抑储备配额。

  Article 14 The municipal department of ecological environment shall determine the annual target carbon intensity of key emission units according to the reduction target of carbon emission intensity, the development of the industry, the benchmark carbon intensity of the industry and other factors, use the benchmark method and history method to pre-allocate quotas, and verify the actual quotas。重点排放单位年度目标碳强度的设定不得超出上一年度目标碳强度。

  Article 15 The municipal ecological environment competent department shall determine the pre-allocation quota of key emission units according to the quota allocation method, and issue the pre-allocation quota of the current year before March 31 of each year。

  当年度预分配配额不能用于履行上一年度的配额履约义务。

  第十六条 市生态环境主管部门应当于每年6月30日前,核定上一年度重点排放单位实际配额。

  If the actual quota of key emission units is less than the pre-allocated quota, the excess pre-allocated quota shall be returned to the municipal ecological environment department before the deadline for compliance, and the part that is not returned on time shall be regarded as excess emission;If the actual quota of key emission units is more than the pre-allocated quota, the municipal ecological environment competent department shall reissue it。

  第十七条 市生态环境主管部门预留年度配额总量的百分之二作为新建项目储备配额,可以根据实际情况动态调整比例。

  Where the annual emissions of a new fixed asset investment project of a key emission unit reach 3,000 tons of carbon dioxide equivalent, it shall report the assessment of carbon emissions of the project to the municipal ecological environment department before putting into operation, and apply for the issuance of reserve quotas for new projects before the completion and acceptance。

  当年度新建项目储备配额全部申请发放完毕后,当年度内不再新增新建项目储备配额。

  第十八条 市生态环境主管部门预留年度配额总量的百分之二作为价格平抑储备配额,可以根据实际情况动态调整比例。When the market quota price falls sharply, or the number of market flow quotas is too high, the municipal ecological environment department can use a certain proportion of paid distribution quotas as price stabilization reserve quotas。

  市场配额价格出现大幅上涨,或者市场流动配额数量过低时,市生态环境主管部门可以释放价格平抑储备配额。

  价格平抑储备配额只能由重点排放单位购买用于履约,不能用于市场交易。价格平抑储备配额采用拍卖的方式出售。

  第十九条 重点排放单位配额、新建项目储备配额分配以免费为主,适时引入有偿分配。

  The municipal competent department of ecological environment shall formulate an annual quota allocation plan, including the total amount of quota, the method of quota allocation, the proportion of paid quota allocation, etc., which shall be submitted to the municipal people's Government for approval and announced to the public and organized for implementation。

  Article 20 The municipal department of ecological environment shall, in accordance with the annual quota allocation plan, allocate the specified annual carbon emission quota to the key emission units through the carbon emission right registration system, and inform the key emission units。

  重点排放单位对分配的碳排放配额有异议的,It may apply to the municipal ecological environment department for review within seven working days from the date of receiving the distribution results;The municipal ecological environment department shall make a decision on the review within 10 working days from the date of receiving the application for review,并将复核结果书面告知重点排放单位。

  第二十一条 重点排放单位应当在碳排放权注册登记系统开立账户,进行相关业务操作。

  The carbon emission rights registration system records the information of issuance, holding, transfer, pledge, performance, offsetting, cancellation and carry-forward of carbon emission allowances and certified emission reductions as the basis for judging the holding of carbon emission allowances and certified emission reductions。

  第二十二条 上一年度的配额可以结转至后续年度使用。

  第二十三条 以配额或者核证减排量设定质押的应当办理质押登记,并向市生态环境主管部门提交下列材料:

  (1) Application for registration of pledge;

  (2) the applicant's identity certificate;

  (3) a pledge contract;

  (4) principal creditor's rights contract;

  (五)交易机构出具的质押见证书。

  If the application materials submitted by the applicant are complete, the municipal ecological environment department shall, within ten working days from the date of receipt of the pledge registration application, complete the pledge registration work and issue a pledge announcement;If the application materials submitted by the applicant are incomplete, the applicant shall inform the applicant in writing of the materials that need to be supplemented in one time。

  The pledge announcement includes the following:

  (1) to pledge the party;

  (二)质押的配额或者核证减排量数量;

  (3) the time limit of the pledge。

  Article 24 Where the industries of key emission units are inconsistent with the industries determined in the annual quota allocation plan, they shall submit the following materials to the municipal ecological environment competent department for quota adjustment before March 31 of each year, and the annual target carbon intensity after adjustment shall not be higher than the target carbon intensity of the previous year:

  (1) Application for change;

  (二)涵盖单位主要产品、产值等相关内容的财务审计报告;

  (三)营业执照复印件、法人授权委托书等材料。

  市生态环境主管部门受理申请后进行审核,重新确定申请单位的年度目标碳强度,并根据年度目标碳强度确定配额数量。

  Article 25 Where key emission units are merged with other units, their quotas shall be taken over by the units that survive the merger or the newly established units, and shall be reported to the municipal ecological environment department for record within 15 working days from the date of completion of commercial registration。

  重点排放单位分立的,应当制定配额分割方案,并自完成商事登记之日起十五个工作日内报市生态环境主管部门备案。未按时报市生态环境主管部门备案的,原重点排放单位的履约义务由分立后的单位共同承担。

  From the next year after the merger or division of key emission units, the municipal ecological environment department shall set the annual target carbon intensity for the merged or divided units according to the industry to which they belong, and the annual target carbon intensity of the merged or divided units shall not exceed the target carbon intensity of the previous year of the original key emission units。

  26th key discharge units have one of the following circumstances, the municipal ecological environment department shall be removed from the list of key discharge units, and inform the result of removal:

  (1) moving out of the administrative area of this Municipality;

  (二)因停业、关闭等情况不再从事生产经营活动的;

  (3) commencement of bankruptcy proceedings;

  (四)连续三年碳排放量低于三千吨二氧化碳当量的;

  (五)市生态环境主管部门确定的其他需要移出的情形。

  重点排放单位被移出名单后,应当在被移出名单后十五日内将预分配配额缴纳至市生态环境主管部门。

Chapter III Carbon emission trading

  Article 27 Trading institutions shall be responsible for formulating trading rules such as trading methods and trading service fees, which shall be submitted to the municipal ecological environment department for review and submitted to the municipal local financial regulatory department for filing and then issued for implementation。

  碳排放权交易应当采用单向竞价、协议转让或者其他符合规定的方式进行。

  Article 28 Key emission units and other organizations and individuals complying with the provisions of the trading rules may participate in the trading of carbon emission rights and pay trading services to the trading institutions in accordance with the provisions。

  第二十九条 碳排放权交易品种包括碳排放配额、核证减排量和市生态环境主管部门批准的其他碳排放权交易品种。

  Encourage new types of carbon emission trading。

  Article 30 Holders of quotas or certified emission reductions may sell, pledge or trust quotas or certified emission reductions, or obtain income or financing support by other lawful means。

  Article 31 Carbon emission trading entities shall not trade illegally obtained quotas or certified emission reductions, shall not manipulate the carbon emission trading market by means of fraud, malicious collusion, or spreading false information, and shall not engage in other trading activities prohibited by relevant competent authorities and trading institutions。

  The municipal ecological environment department and other departments, trading institutions, third-party verification institutions and their staff shall not hold, buy or sell carbon emission quotas;Carbon emission quotas already held shall be transferred or cancelled according to law。

  第三十二条 碳排放权交易资金实行第三方存管,存管银行应当按照有关规定进行交易资金的管理与拨付。

  碳排放权注册登记系统应当与碳排放权交易系统实现信息互联互通,及时完成交易品种的清算和交收。

  第三十三条 交易机构应当建立大额交易监控、风险警示、涨跌幅限制等风险控制制度,维护市场稳定,防范市场风险。

  当发生重大交易异常情况时,交易机构应当及时向市生态环境主管部门报告,并采取限制交易、临时停市等紧急措施。

  市生态环境主管部门会同市地方金融监管部门做好碳排放权交易场所金融风险监管和处置。

  第三十四条 鼓励组织或者个人开立公益碳账户,购买核证减排量用于抵销自身碳排放量,实现自身的碳中和。

  第三十五条 市人民政府按照规定设立碳排放交易基金,用于支持碳排放权交易市场建设和碳减排、碳中和重点项目。

Chapter IV Emission verification and quota compliance

  第三十六条  市生态环境主管部门应当建立温室气体排放信息报送系统,碳排放单位应当按照市生态环境主管部门的要求,根据行业数据基础条件等因素逐步实现在温室气体排放信息报送系统申报年度碳排放量等信息,申报单位具体范围由市生态环境主管部门另行确定。

  Article 37 Key emission units shall prepare the carbon emission report of the previous year in accordance with the technical standards for carbon emission quantification and reporting, submit it to the municipal ecological environment department before March 31 of each year, and be responsible for the authenticity, integrity and accuracy of the annual carbon emission report。碳排放报告所涉数据的原始数据凭证和管理台账应当至少保存五年。

  市生态环境主管部门组织开展对年度碳排放报告的核查,并将核查结果告知重点排放单位。核查结果作为重点排放单位碳排放配额的履约依据。

  If the key discharge units have objections to the verification results, they may apply for a review within seven working days from the date of receipt of the verification results, and the municipal ecological environment department shall conduct a review within ten working days from the date of receipt of the review application and inform the key discharge units of the review results in writing。复核结果与核查结果不一致的,以复核结果作为重点排放单位碳排放配额的履约依据。

  The municipal industry and information technology, housing construction, transportation and other departments shall cooperate with the municipal ecological environment department to verify and review the annual carbon emission reports of key emission units, and cooperate to provide relevant information such as energy consumption data and production and operation status of key emission units。

  市生态环境主管部门可以通过购买服务的方式委托具有相应能力的第三方核查机构提供核查、复核服务。

  第三十八条 重点排放单位应当于每年3月31日前向市生态环境主管部门提交上一年度的生产活动产出数据报告。The municipal ecological environment competent department may entrust professional institutions to verify the output data report of the production activities of key emission units, and carry out the consistency review of the output data of production activities together with relevant departments before May 31 each year。

  重点排放单位的生产活动产出数据核算边界应当与碳排放数据核算边界保持一致,生产活动产出数据为负值时,认定为零。

  重点排放单位对其生产活动产出数据报告的真实性、完整性、准确性负责。

  第三十九条 重点排放单位应当于每年8月31日前向市生态环境主管部门提交配额或者核证减排量,配额及核证减排量数量之和不低于其上一年度实际碳排放量的,视为完成履约义务;逾期未提交足额配额或者核证减排量的,The shortfall is deemed to be excess emissions。

  第四十条 市生态环境主管部门签发的当年度实际配额不足以履约的,重点排放单位可以使用核证减排量抵销年度碳排放量。One certified emission reduction is equivalent to one quota。最高抵销比例不超过不足以履约部分的百分之二十。

  可以使用的核证减排量包括下列类型:

  (1) Voluntary emission reduction certified by the State;

  (2) The municipal carbon inclusive certification of emission reduction;

  (三)市生态环境主管部门批准的其他核证减排量。

  重点排放单位在本市碳排放量核查边界范围内产生的核证减排量不得用于本市配额履约义务。

  第四十一条 市生态环境主管部门应当注销下列配额或者核证减排量,并向社会公布除第三项以外的注销信息:

  (一)未使用的上一年度新建项目储备配额;

  (二)五年未使用的价格平抑储备配额;

  (三)实际配额核定后收回的重点排放单位配额;

  (四)重点排放单位为履行上一年度履约义务递交的配额和使用的核证减排量;

  (五)根据本办法第二十六条规定收缴的配额;

  (六)自愿申请注销的配额或者核证减排量。

Chapter V Supervision and administration

  第四十二条  市生态环境主管部门和其他相关部门可以结合工作实际,组织制定碳排放权交易及其相关活动的地方标准。

  Encourage and support trading institutions, key emission units, third-party verification institutions, professional institutions, and industry associations to formulate corporate or collective standards for carbon emission trading and related activities。

  第四十三条 市生态环境主管部门会同其他相关部门对重点排放单位、交易机构、第三方核查机构和专业机构进行联合检查。被检查者应当如实反映情况,并提供必要资料。

  检查人员实施检查时,应当出示证件,可以采取现场监测、查阅或者复制相关资料等措施,并对知悉的商业秘密予以保密。

  第四十四条 市生态环境主管部门应当定期公布重点排放单位年度碳排放配额履约情况等信息。

  Trading institutions shall establish and improve the information disclosure system, timely release the relevant information of the carbon emission rights trading market, and regularly report the carbon emission rights trading, settlement and other activities and the operation of institutions to the municipal ecological environment department。

  Key emission units shall, after completing the implementation of the agreement, disclose the completion of the target carbon intensity of the previous year on the platform designated by the municipal ecological environment department before December 31 of the year。

  Article 45 Third party verification institutions engaged in carbon emission verification activities and professional institutions engaged in production output data verification activities shall establish and improve the internal quality control system, and be responsible for the authenticity, integrity and accuracy of the data, reports and other documents issued by them。

  第三方核查机构、专业机构应当独立、客观、公正地开展核查工作,并履行保密义务。

  The municipal ecological environment department and other relevant departments should strengthen the cultivation of third-party verification institutions and professional institutions, regularly train key emission units and inspectors, and improve their business capabilities。

  第四十六条 建立碳排放权交易信用记录制度。Carbon emission trading entities, third-party verification institutions, professional institutions in violation of the provisions of the administrative punishment, the municipal ecological environment department and other relevant departments shall record their credit status, and credit records in accordance with the provisions of the public credit information management system to publish to the public。

  第四十七条 市生态环境主管部门可以对碳排放权交易市场运行成效开展评估,并根据评估结果调整年度配额分配方案。

  Trading institutions can evaluate the efficiency, safety, stability and other aspects of the carbon emission trading market, and optimize trading rules and innovate trading varieties according to the evaluation results。

  Article 48 Any organization or individual may report or complain to the municipal ecological environment, statistics, local financial supervision and other departments about illegal acts in the process of carbon emission rights trading。

  The department accepting the report or complaint shall promptly investigate and handle the matters that fall within its responsibilities and report the results of the handling to the informant or the complainant, and at the same time keep the information of the informant or the complainant confidential。

  Article 49 Where any organization or individual considers that the specific administrative act made by the municipal ecological environment department or other relevant departments in the process of carbon emission trading administration infringes on its legitimate rights and interests, it may apply for administrative reconsideration or bring an administrative lawsuit according to law。

Chapter VI Legal liability

  Article 50 Administrative organs and their staff who fail to perform their management duties in accordance with the provisions of these measures shall be investigated for administrative responsibility according to law;Those suspected of committing crimes shall be transferred to judicial organs for handling according to law。

  第五十一条 重点排放单位未在本办法第三十七条规定期限内提交年度碳排放报告的,市生态环境主管部门应当催告其限期提交;期满仍未提交的,Fined $50,000,由市生态环境主管部门测算其年度实际碳排放量,These emissions will be used as a basis for compliance。

  Key discharge units fail to submit production activity output data reports within the time limit stipulated in Article 38 of these measures, the municipal ecological environment department shall urge them to submit within a time limit;If it has not been submitted at the expiration of the time limit, the output data of its production activities shall be identified as zero by the municipal ecological environment competent department。

  第五十二条 有下列情形之一的,由市生态环境主管部门按照下列规定处理:

  (1) In violation of the provisions of the second paragraph of Article 16 of these Measures, key emission units fail to return the excess pre-allocated quotas on time, shall be ordered to make corrections within a time limit;If it fails to correct within the time limit, it shall be fined three times the average price of the quota for the six consecutive months before the month of performance of the agreement;

  (2) In violation of the provisions of the first and second paragraphs of Article 25 of these measures, key emission units fail to report the merger or division to the municipal ecological environment department for record, ordered to correct within a time limit;If he fails to make corrections within the time limit, he shall be fined 50,000 yuan and his illegal gains shall be confiscated according to law;

  (C) in violation of the provisions of the second paragraph of article 26 of these Measures, the key discharge units are removed from the list of key discharge units after the pre-allocated quota is not enough to collect, ordered to correct within a time limit;If he fails to make corrections within the time limit, he shall be fined 100,000 yuan and his illegal gains shall be confiscated according to law;

  (4) In violation of the provisions of the first paragraph of Article 31 of these Measures, a carbon emission trading entity engaged in illegal trading activities, shall be ordered to stop the illegal act, confiscate the illegal income according to law, and impose a fine of 50,000 yuan, if the circumstances are serious, impose a fine of 100,000 yuan;If losses are caused, they shall be liable for compensation according to law;

  In violation of the provisions of the second paragraph of Article 31 of these Measures, trading institutions, third-party verification institutions and their staff hold, buy and sell carbon emission quotas, the illegal income shall be confiscated according to law, and the unit shall be fined 100,000 yuan, and the individual shall be fined 50,000 yuan;

  (5) In violation of the provisions of Article 36 of these Measures, carbon emission units fail to report annual carbon emissions and other information in the greenhouse gas emission information submission system as required, shall be ordered to correct within a time limit;Those who fail to make corrections within the time limit shall be fined 10,000 yuan;

  (六)违反本办法第三十七条第一款、第三十八条第三款的规定,重点排放单位虚报、瞒报、漏报年度碳排放报告或者生产活动产出数据报告的,Order correction within a time limit,Fined $50,000,serious,A fine of 100,000 yuan;对虚报、瞒报、漏报部分,等量核减其下一年度碳排放配额;

  (七)违反本办法第三十九条的规定,Key emission units fail to fulfill their obligations in full and on time,责令限期补足并提交与超额排放量相等的配额或者核证减排量;逾期未补足并提交的,Mandatory deduction of the same quota,不足部分从其下一年度配额中直接扣除,处超额排放量乘以履约当月之前连续六个月配额平均价格三倍的罚款;

  (八)违反本办法第四十五条第一款、第二款的规定,第三方核查机构、专业机构弄虚作假、篡改、伪造相关数据或者报告的,或者开展核查工作违反独立、客观、公正原则或者未履行保密义务的,Order correction within a time limit,Fined $50,000,serious,A fine of 100,000 yuan;damaging,Be liable for compensation according to law。

  第五十三条  有下列情形之一的,由市生态环境主管部门或者相关部门按照下列规定处理:

  (二)违反本办法第三十三条第二款、第四十四条第二款的规定,交易机构未按规定履行报告义务或者未按规定采取紧急措施的,或者未按规定公布碳排放权交易市场相关信息的,Order correction within a time limit,Fined $50,000,serious,A fine of 100,000 yuan;

  (3) In violation of the provisions of the third paragraph of Article 44 of these Measures, key emission units fail to disclose the completion of the target carbon intensity of the previous year, shall be ordered to correct within a time limit;Those who fail to make corrections within the time limit shall be fined 50,000 yuan; if the circumstances are serious, a fine of 100,000 yuan shall be imposed。

  第五十四条 任何组织或者个人违反本办法的规定,阻挠、妨碍市生态环境主管部门或者相关部门监督检查的,由市生态环境主管部门或者相关部门Fined $50,000,serious,A fine of 100,000 yuan;Suspected of crime,Transfer to judicial organs for handling according to law。

Chapter VII Supplementary Provisions

  第五十五条 本办法下列用语的含义:

  (1) Greenhouse gases,是指大气中吸收和重新放出红外辐射的自然和人为的气态成分,Including carbon dioxide (CO2), methane (CH4), nitrous oxide (N2O), sulfur hexafluoride (SF6), hydrofluorocarbons (HFCs), perfluorocarbons (PFCs), and nitrogen trifluoride (NF3)。

  (2) Carbon emissions refer to emissions of carbon dioxide and other greenhouse gases, including direct emissions of greenhouse gases arising from the burning of fossil fuels or production processes, as well as indirect emissions of greenhouse gases arising from the use of purchased electricity, heat, cold or steam。

  (3) Carbon emission units refer to independent legal entities or other sources of emission that directly or indirectly discharge greenhouse gases into the atmosphere as a result of their activities such as production, business operation and living。

  (4) Carbon emission trading refers to the carbon emission control mechanism through which key emission units fulfill their obligations through the market mechanism, including the quantification, reporting and verification of carbon emissions, as well as the allocation, trading and compliance of carbon emission quotas。

  (九)碳普惠核证减排量,是指碳普惠体系下,符合主管部门备案的碳普惠方法学产生的核证减排量。
